Please Read These Official Rules With Your Parent or Legal Guardian.
No Purchase or Payment Necessary to Enter or Win. Many will enter, few will win. A Purchase Will Not Increase Your Chances of Winning.
Eligibility:The Stride® Spitsville Sweepstakes (“Sweepstakes”) is open to legal residents of the 50 United States and the District of Columbia who are 13 years of age or older as of date of entry. An eligible minor should have his/her parent’s or legal guardian’s permission to participate in this Sweepstakes. Officers, directors, employees, representatives, and agents of Cadbury Adams USA LLC (“Sponsor”), Gold n Fish Marketing Group LLC, JWT Co., Project Support Team, Inc., and any of their respective parents, affiliates, subsidiaries, retailers, distributors, suppliers, and advertising and promotion agencies (collectively, the “Released Parties”), and their immediate family members (for the purposes of this Sweepstakes, defined as a parent, spouse, child, or sibling, and their respective spouses, regardless of where they reside) and those living in their same households, whether or not related, are not eligible to enter or win a prize. Void in Puerto Rico and where prohibited or restricted by law. All applicable federal, state and local laws apply.
Promotion Period: From 12:00:00 pm (noon) Eastern Time (“ET”) on 4/1/08 to 11:59:59 am ET on 6/20/08 (“Promotion Period”).
How To Enter:: If you are under the age of 21 and considered a minor in your jurisdiction of residence, you must have your parent’s or legal guardian’s permission to participate. Visit STRIDEGUM.COM during the Promotion Period and follow the instructions provided to fully complete and submit the Official Entry Form. All entries must be received by 11:59:59 am ET on 6/20/08 to be eligible. Only one (1) entry per person and per e-mail address per day will be accepted for the duration of the Promotion Period. In case of multiple entries received during any day from any one person or e-mail address, only the first entry from that person or e-mail address during that day will be accepted. All entries become the property of Sponsor and will not be acknowledged or returned. The use of script, macro or any automated devices (or any other devices intended to automate any aspect of participation) to enter is prohibited. If Sponsor, in its sole discretion, determines that an entrant has used an automated or similar device to enter, all entries from that entrant will be void. In the event of a dispute as to the identity of an entrant, entry will be awarded to the person named on the applicable entry form (regardless of whether that is the name of the authorized account holder of the e-mail address from which said online entry form was submitted). Released Parties are not responsible for lost, incomplete, invalid, unintelligible, illegible, delayed, inaccurate, undeliverable, late, stolen, garbled, damaged, misdirected or undeliverable entries, all of which will be disqualified; failures or malfunctions of phones, phone lines or telephone systems or other communications malfunctions; interrupted or unavailable network, server, cable, satellite, Internet Service Provider (ISP) or other connections; miscommunications, failed computer hardware or software or other technical failures; garbled, lost, misrouted or scrambled transmissions; any error, omission, interruption, defect or delay in any transmission or communication; traffic congestion on the Internet or for any technical problem, including but not limited to any injury or damage to entrants’ or any other person’s computer or other device related to or resulting from participation in the Sweepstakes; printing, typographical or other errors appearing within these Official Rules or in any Sweepstakes-related advertisements or other materials; or other errors or problems of any kind whether mechanical, human, technical, electronic; or errors which may occur in connection with the administration of the Sweepstakes, the processing of entries and the awarding or announcement of the prize.
Winner Selection:Potential winner will be selected in a random drawing conducted on or about 7/7/08 by Project Support Team, Inc. an independent judging organization, from among all eligible entries received. By participating, entrants (and, if eligible minors, their parents or legal guardians) agree to these Official Rules and to the decisions of the Sponsor and Project Support Team, Inc., which will be final and binding in all respects. The potential winner will be notified by telephone and/or overnight mail and/or regular mail. If winner is an eligible minor, the prize will be awarded in name of the parent/legal guardian of minor entrant whose entry is selected as the winner and such parent or legal guardian will be required to fulfill all requirements imposed on winner set forth herein and must accompany such winner on trip as his/her guest. Odds of winning will depend on the total number of eligible entries received. Each entry will have an equal chance of winning.
(1) Grand Prize: A four (4) day/three (3) night trip for winner and one (1) guest to a destination of winner’s choice within the 48 contiguous United States (not to exceed $3,500). Trip includes round trip coach air transportation from major gateway airport nearest winner’s residence in the U.S. to a major gateway airport nearest to winner’s destination, one (1) standard double occupancy hotel accommodations for three (3) nights and $500 spending money for the winner only (awarded in the form of a check). Maximum Approximate Retail Value of Grand Prize = $3,500. Actual value may vary based upon location of winner’s residence and trip destination. If winner chooses a trip valued at less than the maximum retail value of $3,500, winner will not be entitled to receive the difference in such value. If winner chooses a trip valued at more than the maximum retail value of $3,500, winner will not be entitled to the difference in such value. The trip destination chosen shall be subject to Sponsor’s approval in Sponsor’s sole discretion. If winner resides within a 100-mile radius of his/her selected trip destination, ground transportation may be provided in lieu of air transportation, at Sponsor’s sole discretion, and no compensation or substitution will be provided for difference in prize value. Trip must be taken by 12/31/08 or prize will be forfeited and Sponsor will have no further obligation to winner. Certain travel restrictions, blackout dates and other restrictions may apply. Winner and his/her guest must travel together on same itinerary and are responsible for obtaining all required travel documents prior to travel. Guest must be of legal age of majority in his/her jurisdiction of residence (and at least 18) unless child or legal ward of winner and must sign and return a liability/publicity release. If guest is child or legal ward of winner, winner must sign and return release on behalf of such child or legal ward. All travel arrangements must be made through travel agent of Sponsor’s selection on a carrier of Sponsor’s choice. Released Parties are not responsible for travel delays or cancellations. All costs and expenses associated with the acceptance and use of the prize not specified herein as being awarded, including, but not limited to, all federal, state and local taxes, food, additional ground transportation, gratuities, souvenirs, beverages and other travel expenses are winner’s sole responsibility. All prize details are at Sponsor’s sole discretion.
Miscellaneous: No transfer, assignment, cash redemption or substitution of prize except by Sponsor who may substitute the prize (or portion thereof) with one of comparable or greater value, at its sole discretion. Potential winner (and, if an eligible minor, his/her parent or legal guardian) will be required to execute and return an Affidavit of Eligibility, Liability and Publicity Release (where legal) within ten (10) days of date of issuance of notification. Noncompliance with this requirement, with these Official Rules, or prize notification being returned as non-deliverable, may result in disqualification and, at Sponsor’s sole discretion, an alternate winner being selected. Sponsor reserves the right, in its sole discretion, to void any entries of any entrant whom Sponsor believes has attempted to tamper with or impair the administration, security, fairness or proper play of this Sweepstakes. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND/OR OTHER REMEDIES (INCLUDING ATTORNEYS’ FEES) FROM ANY SUCH PERSON(S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW. Sponsor reserves the right, in its sole discretion, to modify, suspend, and/or terminate this Sweepstakes (or portion thereof) should virus, bugs, non-authorized human intervention or other causes, including but not limited to war, strikes, and/or acts of God, corrupt or impair the administration, security, fairness or proper play of the Sweepstakes and, in the case of termination, at its discretion, select the winner from eligible non-suspect entries received prior to the event requiring such termination.
By participating, entrants (and, if eligible minors, their parents or legal guardians) agree: 1) that Sponsor and its designees may use, each winner’s name, (and, if an eligible minor, his/her parent’s or legal guardian’s name), city and state of residence, photograph and/or likeness for advertising, trade and/or any other purposes in any and all media now or hereafter known throughout the world in perpetuity, without further compensation, permission or notification (unless prohibited by law); 2) to release, discharge, indemnify and hold harmless the Released Parties from and against any claim, action, liability, loss, injury or damage to entrant or any other person or entity, including, without limitation, claims relating to defamation, invasion of privacy, personal injury or death to entrant or any other person or damage to personal or real property, due in whole or in part, directly or indirectly, by reason of (a) the acceptance, possession, use or misuse of any prize and any travel or travel-related activity thereto, (b) administration of the Sweepstakes, or (c) participation in this Sweepstakes or any related activity; 3) to waive all rights to claim or collect punitive, incidental, consequential or any other damages; 4) that all causes of action relating to this Sweepstakes will be resolved individually without resort to any form of class action; 5) that any and all claims, judgments, or awards shall be limited to actual out-of-pocket costs incurred, excluding attorneys’ fees; and 6) that New York law shall apply exclusively to the Sweepstakes and that any dispute with respect to the Sweepstakes shall be resolved in either the federal or state courts located in the State of New York. Sponsor is not responsible for any inability of the potential winner to accept the prize, and reserves the right, at its sole discretion, to disqualify or eliminate such winner and, at Sponsor’s sole discretion, award prize to an alternate winner.
